Privacy Policy
1. MAIN CONCEPTS
1.1. Company Data Controller – Sole Proprietorship "Smiltė," established and operating in accordance with the laws of the Republic of Lithuania, with the legal entity code 134038222, registered office address at S. Banaičio 49, Kaunas, Lithuania.
1.2. Client or Data Subject – a natural person who is a client of the Company (including website visitors) whose personal data is collected by the Company.
1.3. Online Store – the Company's online store at www.dekoroidejos.lt.
1.4. Services – all services provided by the Company.
1.5. Personal Data – any information related to a natural person – the Data Subject, whose identity is known or can be directly or indirectly determined using such data as a personal identification number, one or more features characteristic of the physical, physiological, psychological, economic, cultural, or social identity of that person.
1.6. Personal Data Processing – any operation performed on personal data: collection, recording, accumulation, storage, classification, grouping, merging, modification (supplementation or correction), provision, disclosure, use, logical and/or arithmetic operations, search, dissemination, destruction, or other operations or sets of operations.
1.7. Partner – a legal entity providing services to the Company related to the Company's activities or selling goods to it, or conducting joint projects with the Company, including but not limited to marketing campaigns, joint sales campaigns, loyalty programs, and others in media, websites, the Online Store, retail stores, shopping networks, etc.
1.8. Cookie – a small piece of textual information automatically created while browsing the website and stored on the visitor's computer or other device.
1.9. Direct Marketing – activities aimed at offering goods or services directly to individuals by mail, phone, or other direct methods and/or inquiring about their opinion regarding the offered goods or services.
1.10. Privacy Policy – this document, which establishes the principles and rules for processing Personal Data while using the Online Store services.
1.11. Account – the main data for the Client to log in to the Online Store, consisting of one email address and a Password.
1.12. Password – a unique combination of numbers, letters, or a mix of numbers, letters, and other symbols created by the Client, enabling access to the Online Store.
2. GENERAL PROVISIONS
2.1. The Client grants the Company the right to perform all actions with their Personal Data to the extent and for the purposes specified in this Privacy Policy.
2.2. Personal Data is processed in accordance with the Republic of Lithuania Law on Legal Protection of Personal Data and other laws governing Personal Data processing and protection, as well as this Privacy Policy.
2.3. The Company's Personal Data is processed according to the following principles:
2.3.1. Personal Data is collected for specified and lawful purposes;
2.3.2. Personal Data is processed accurately, fairly, and lawfully;
2.3.3. Personal Data is adequate and only to the extent necessary for its collection and further processing;
2.3.4. Personal Data is constantly updated;
2.3.5. Personal Data is stored in a form that allows the identification of the Data Subject no longer than necessary for the purposes for which the data was collected and processed.
2.3.6. All information about Personal Data is confidential;
2.3.7. The Client's Personal Data and personal information will not be used for unlawful purposes.
2.4. It is considered that the Client, by purchasing from the Online Store, has read and agreed to the current version of the Privacy Policy. If the Client disagrees with any part of the Privacy Policy, the Client must refrain from placing an order and purchasing from the Online Store.
2.5. The Privacy Policy can be accessed on the Online Store at any time and printed out. The Privacy Policy may be amended, supplemented, or updated at the Company's discretion. The new version of the Privacy Policy is published on the Online Store.
2.6. The Client may place an order on the Online Store without registration or through their Account by registering on the Online Store.
2.7. During the initial registration to the Online Store via an Account, the Client must provide their email address, create a secure Password, and provide accurate Personal Data to the Online Store. The Client is responsible for their accuracy. Upon creating an Account, the Client is assigned an identification code.
2.8. While using Services or purchasing from the Online Store, the Client must always provide accurate Personal Data to the Online Store and is responsible for their accuracy.
2.9. The Client has the right to change and supplement their Personal Data in their Account at any time or contact the Online Store to request the Account's deletion.
2.10. The Client must not disclose their Password to third parties and must ensure its security; otherwise, all associated liability rests with the Client.
3. PROCESSING OF PERSONAL DATA
3.1. The Company collects and processes the Client's Personal Data for the following purposes:
3.1.1. For identifying the Client when purchasing from the Online Store;
3.1.2. For processing and delivering orders;
3.1.3. For issuing financial documents related to purchases;
3.1.4. For addressing problems related to the delivery or quality of goods;
3.1.5. For fulfilling other contractual obligations;
3.1.6. For improving the operation of the Online Store and offering more personalized services;
3.1.7. For direct marketing purposes, if the Client has given their consent to this.
3.2. The Company collects and processes the following Client Personal Data:
3.2.1. For purchases made through the Online Store, the Client must provide the following data: name, surname, contact phone number, email address, delivery address, and other information relevant to fulfilling the order.
3.2.2. When creating an Account, the Client provides: name, surname, contact phone number, email address, delivery address, and other details necessary for Account management.
3.3. The Company also collects information indirectly through Cookies to enhance the Online Store's functionality and user experience.
3.4. The Client is responsible for ensuring the accuracy of all provided Personal Data.
3.5. The Company does not process Sensitive Personal Data (e.g., relating to health, religious beliefs, or political opinions) unless required by law.
4. PROVISION OF PERSONAL DATA TO THIRD PARTIES
4.1. The Company has the right to share the Client’s Personal Data with third parties only under the following conditions:
4.1.1. To service providers or Partners working with the Company in delivering products or services purchased by the Client;
4.1.2. When required by law or judicial authorities;
4.1.3. For fulfilling the Company’s legitimate interests in cases permitted by law;
4.1.4. With the Client’s explicit consent.
4.2. The Company guarantees that shared Personal Data will only be used for the specified purposes and protected under confidentiality agreements.
5. CLIENT RIGHTS
5.1. Clients have the following rights regarding their Personal Data:
5.1.1. To access their Personal Data held by the Company;
5.1.2. To request correction of inaccurate or incomplete Personal Data;
5.1.3. To request deletion of their Personal Data if it is no longer necessary for the purposes for which it was collected;
5.1.4. To object to the processing of their Personal Data for direct marketing purposes;
5.1.5. To withdraw consent for processing Personal Data at any time;
5.1.6. To lodge a complaint with the supervisory authority if their rights are violated.
5.2. The Client can exercise these rights by contacting the Company via email or other provided communication methods.
6. SECURITY OF PERSONAL DATA
6.1. The Company employs appropriate technical and organizational measures to ensure the security of Personal Data against unauthorized access, accidental loss, destruction, or disclosure.
6.2. Clients are responsible for maintaining the confidentiality of their Account details, including their Password.
6.3. If the Client suspects that their Account security has been compromised, they must notify the Company immediately.
7. COOKIES
7.1. The Online Store uses Cookies to enhance user experience and functionality. By using the Online Store, the Client agrees to the use of Cookies.
7.2. The Client can manage or delete Cookies in their browser settings. However, disabling Cookies may affect the functionality of the Online Store.
8. DIRECT MARKETING
8.1. The Company may use Personal Data for direct marketing purposes, provided that the Client has given their consent.
8.2. The Client may opt out of receiving direct marketing communications at any time by following the instructions in the email or contacting the Company.
9. FINAL PROVISIONS
9.1. The Privacy Policy is governed by the laws of the Republic of Lithuania.
9.2. Any disputes arising from this Privacy Policy shall be resolved through negotiations. If no agreement is reached, the disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
9.3. This Privacy Policy is effective as of the date of its publication on the Online Store.
